At it's meeting on 10 May Council resolved:

 That Council:

  1. Notes the outcome of public consultation in Report No 106-22 of 10 May 2022.
  2. Does not proceed with a request by Pembroke School to revoke Community Land classification of five parcels of Community Land located at Haslam Oval and Dunstan Avenue Kensington Park.
  3. Advises Pembroke School accordingly.
  4. Authorises the Chief Executive Officer to obtain and effect appropriate easement rights and/or management arrangements through any means possible in relation to the subject land and any Council drainage infrastructure.
  5. Contacts the respondents of the public consultation and advises them of the outcome of the Council’s determination.

Haslam Oval is privately owned and is bordered by The Parade, Gurrs Road, Beulah Road and properties on Dunstan Avenue, Kensington Park.

Council owns five (5) parcels of Community Land adjoining Haslam Oval. Council has resolved to seek community feedback on the potential revocation of Community Land classification of these parcels, totaling approximately 706m², noting that Pembroke School has expressed interest in purchasing them to enable a Haslam Oval Precinct Master Plan to proceed.

These parcels are located at Dunstan Street, Kensington Park and Beulah Road, Kensington Park and are comprised in:

  • Parcel A - 38m² portion adjacent Haslam Oval and Beulah Road comprised in Volume 5910 Folio 398.
  • Parcel B – 190m² portion adjacent Haslam Oval and Beulah Road comprised in Road Plan 1968.
  • Parcel C – 69m² portion adjacent Haslam Oval and properties on Dunstan Avenue comprised in Certificate of Title Volume 360 Folio 120.
  • Parcel D – 5m² portion located within privately owned land on Dunstan Avenue comprised in Road Plan 4709.
  • Parcel E - 404m² portion adjacent Haslam Oval and properties on Dunstan Avenue comprised in Certificate of Title Volume 360 Folio 120.

As these portions of land are classified as community land, the Community Land Classification of this land needs to be changed (or ‘revoked’) before any sale can occur. The revocation process requires that Council must consult with the community.

In July 2015, Council was contacted by Pembroke School, who had undertaken a “Whole of School Facility Master Plan”. Through the process, Pembroke School discovered that small strips of land adjacent to Haslam Oval, which were previously believed to be owned by the school, were in fact drainage reserves owned by the City of Burnside.

It was also identified that there was a large drainage pipe, forming part of the City of Burnside’s stormwater system, which traversed under Haslam Oval without an easement in place.

The school indicated its desire to acquire the parcels of land, along with two nearby closed road parcels (both Community Land) and grant an easement in favour of Council for stormwater pipe that traverses Haslam Oval.

Any person is entitled to make a submission about this proposal which will be presented to Council for consideration. Any person who makes a submission will be informed of the time and date of a meeting of Council for consideration of their submission should they wish to attend or make a deputation.
