Proposed Revocation of portions of Community Land - Public Consultation

Notice is hereby given, pursuant to Section 194 of the Local Government Act 1999, that the City of Burnside has resolved to commence public consultation for the revocation of the Community Land classification of:

  • Lot 182 in Deposited Plan 2906 and described in CT Volume 418 and Folio 56 (approx. 1,467 square metres) being 1A Gulfview Avenue, St Georges (JB Cleland Kindergarten).
  • Lot 140 in Deposited Plan 750 and described in CT Volume 5811 and Folio 108 (approx. 1,003 square metres) being 70A-C Hewitt Avenue, Rose Park (Rose Park Preschool and Scout Hall).
  • Lot 102 in Filed Plan 27036 and described in CT Volume 5808 Folio 851 (approx. 1,913 square metres) being 41 Grant Avenue, Rose Park (Gurney Road Garden).

Council has determined that the Community Land is surplus to its requirements and has resolved to pursue the sale of the site to the State Government, subject to community feedback and Ministerial consent. Should the sale proceed, revenue generated will be applied towards the acquisition of Constable Hyde Memorial Garden, Leabrook, from the State Government.

To facilitate the disposal of the subject land, Council must first seek revocation of Community Land status for the subject land.

Any submissions in reference to the above proposal must be in writing addressed to Manager, Asset Services, City of Burnside, PO Box 9, Glenside SA 5065 or please feel free to submit an email below. All submissions must be received by no later than 5 pm on Monday 30 March 2015. Council will consider all submissions relating to the proposal received by the due date.

    After several months of working closely with all stakeholders, the Council Administration and the State Government were able to negotiate a new proposal that was consistent with the community feedback.

    This new proposal was presented to Council at its meeting on 13 October 2015. Council resolved to seek Ministerial approval to revoke the community land classification of the Rose Park Preschool and JB Cleland Kindergarten only.

    The Rose Park Scout Hall and the Gurney Road Garden will remain as community land, an outcome strongly supported by the Burnside community.

    This decision allows Council to seek Ministerial approval to revoke the community land classification of the Rose Park Preschool and JB Cleland Kindergarten. Should Ministerial approval be received, Council may then resolve to proceed with negotiations to transfer this land to the State Government and acquire Constable Hyde Memorial Gardens, saving it as community land.
