Lodging Houses Draft By-Law

The City of Burnside Council recently approved public consultation for a new By-Law to regulate lodging houses within the City.

Lodging Houses

A Lodging House includes any building or part thereof which is let, proposed to be let or available to be let for lodging or board and lodging, and is occupied by more than five people who are not members of the proprietor’s family. This does not include the residential portion of hotels and motels, schools, institutional buildings accommodating members of the staff of an institution, supported residential facilities or any building which comes within the definition of a flat.

Purpose of new draft By-Law

The new draft By-Law is to set rules for the controlling, licensing, inspection and regulation of lodging houses within the City. It is intended to balance the needs of the operators with the needs of the inhabitants of our lodging houses.

The new draft By-Law does not seek to impose unreasonable or onerous requirements on the operators of lodging houses, but does ensure basic standards of health, hygiene and liveability for inhabitants of lodging houses within the City.

Community Consultation

We invite you to provide comment on the draft By-Law during the consultation period which runs from Monday 4 November to Monday 9 December 2013.

    At the Council Meeting on 26 February 2013, Council resolved that the Administration prepare a report by June 2013, which investigates the feasibility of Council introducing a Lodging Houses By-Law.

    At the Council Meeting on 11 June 2013, the Council received a report about the feasibility of creating a Lodging Houses By-Law and resolved to start the process of developing one.

    The Administration sought legal advice in relation to drafting the By-Law and the By-Law making process, and then undertook formal engagement on a draft By-Law. The Lodging Houses draft By-Law engagement concluded on 9 December 2013.

    The purpose of the By-Law is to provide the control, licensing, inspection and regulation of lodging houses. This is to ensure that public health and building safety standards are maintained in such facilities.

    The draft Lodging Houses By-Law and the required report were sent to the Legislative Review Committee of Parliament for Gazettal; and later came into operation on 1 September 2014. To view this By-Law visit www.burnside.sa.gov.au.

    The By-Law relates to the Be the Future of Burnside Strategic Community Plan 2012-2025, “a range of housing that meets the varying needs of the community.”
