What is a dry zone?
A ‘dry zone’ is a declared area where the consumption, and/or opened possession of alcohol is prohibited. Any person who consumes or has possession of opened alcohol in a dry area is guilty of an offence which carries a financial penalty. Offenders may be issued with an expiation notice.
Is Council applying for a 24/7 dry zone for all of Tusmore Reserve?
No. If the proposal is supported by the community and state government, a 24/7 dry zone would apply within the fenced area of the wading pool.
Why is Council engaging with the community on the establishment of a 24/7 dry zone?
Before the Commissioner for Liquor Licensing can consider Council’s application, Council will need to demonstrate that it has conducted broad and meaningful engagement with its community.
Why is a dry area being proposed?
The City of Burnside aims to provide safe and accessible public spaces for all members of the community. The purpose of a dry area is to encourage parental supervision of children and toddlers using the pool and to minimise the risk of broken glass in the pool.
Would I be able to consume alcohol at a family picnic or barbeque in Tusmore Park?
The consumption of alcohol is permitted within the park, except potentially within the fenced area of the wading pool.
Council’s Bylaw 3 - Local Government Land limits the consumption of alcohol in all open spaces (including reserves and parks) to between 9 am and 9 pm.
When will the dry zone be implemented?
If supported it is planned that a seasonal dry zone could be in place ahead of the 2023/24 pool season from October to April.
Who manages and enforces the dry zone?
It is the responsibility of SA Police to monitor and enforce dry areas. Breaches of dry area regulations can be reported to Police on 131 444.
How will people know they are in the dry zone?
Signage will be erected support users of the wading pool to understand the new regulation.
