Gurney Road Garden is located at 41 Grant Avenue, Rose Park, and is approximately 2,000 square metres in area.
The site is owned by Council and is designated Community Land.
The land was once a road reserve being the continuation of Victoria Terrace connecting Alexandra Avenue with Grant Avenue, Rose Park. In 1988, the road reserve was closed and Gurney Road Garden created as a joint initiative between the City of Burnside and Rose Park Primary School (the School), in which the School and the community shared use of the reserve.
Since 2010 a licence agreement has been in place requiring the School to maintain Gurney Road Garden with non-exclusive rights to use the land for school sport and recreational activities each school day between the hours of 8 am and 5 pm and on Saturday mornings from 8 am to 12 noon.
With Council's approval, the School installed artificial playing surfaces; a sand pit to the western side; new swings to the southern end; seating around some of the trees; and a three metre high safety net to the southern end of the reserve (Grant Avenue).
New licence proposal
In 2015 the Department of Education and Child Development (DECD) requested that Council grant a new licence to the Minister for Education and Child Development for the benefit of the students of the School during school hours (the Proposal).
Under this proposed licence, the School would maintain Gurney Road Garden with exclusive rights to use the land for school sports and recreational activities each school day between 8 am and 4 pm (not on Saturdays). Community access to the reserve would not be available during these times, but remains accessible outside of these times.
DECD advise that the purpose of the Proposal is to ensure that students who attend the School are able to do so in a safe and secure environment.
The Proposal includes:
- An initial term of five years plus one renewal term of five years.
- Exclusive use of the reserve by the Rose Park Primary School on school days from 8 am to 4 pm.
- Installation of new signage at entrances to the reserve advising that public access is to be restricted during school hours.
Remaining terms are to be in accordance with the existing (current) licence over Gurney Road Garden.
Can I have my say?
Yes.
Council is consulting with the community to ask if a proposal from DECD for a new licence over Gurney Road Garden is acceptable.
Under this Proposal, access to the reserve by the public would be restricted on school days between 8 am and 4 pm. Community access to the reserve would still be available outside of these times.
DECD advise that the purpose of the Proposal is to ensure that students who attend the School are able to do so in a safe and secure environment.
